In-Use Off-Road Rule Status

In February 2010 ARB suspended enforcement of the rule and committed to revising the rule to account for:

  • The effect of the recession and the ability of companies and public entities to cover the costs required by the rule.
  • Better emission inventory data.
  • Litigation from industry groups.

On December 17, 2010, ARB adopted proposed revisions to the rule. These are substantial changes. The changes are summarized in the ArrowTek Overview.

As indicated in our overview, the first compliance date is now January 1, 2014. Be advised that fleets are still required to comply with:

  • Idling restrictions.
  • Notifying ARB within 30 days of equipment purchased or sold.
  • Large fleet compliance certifications (due March 1, 2011 for the fleet as it existed on January 1, 2011).
  • Engine hour recording and reporting for equipment classified as "permanent low use."
  • Notifying buyers of equipment that it could be subject to the off-road rule.
  • Pending restriction on purchase of Tier 0 equipment.
